My husband started a business one year ago. Due to his non-compete the business was put in my name. How do I go about getting my name off of the business? Can I sell it to him or just sign it over? Please help.
It really sounds like you need legal advice on this one. Because you are husband and wife, he could be considered a partner already, depending on what state you live in. And, depending on the size and complexity of your business, you may need only to transfer the business license, or you may need a Buy/Sell Agreement with publishing in the paper of a transfer of assets. There are just a huge number of variables here. The more important it is to you to have it done right, the more important it is to seek legal counsel.
Is your business sole proprietor, LLC, Incorporated, etc.? This will make a difference in the transfer of your business, especially depending on state/local laws & regulations. It's possible it will be a simple business for sale transfer, but I would recommend seeking advice of legal counsel in your local area. Best of luck.
